New York daycare insurance requirements: identify your regulator first

An OCFS-regulated child day care center and a New York City group child care program should not use the same licensing checklist. For OCFS centers, 18 NYCRR 418-1.15(c)(28) addresses keeping the insurer’s certificate showing intended general liability coverage upon licensure and the policy issued afterward. A New York appellate decision applying this rule upheld a violation involving a center’s lapse in liability insurance.

This is an older agency publication; confirm current submission instructions with your OCFS licensor. The practical buying question is whether the insurer can supply the required evidence and keep the licensed operator continuously covered.

For a city group child care center, use the NYC Health Department’s Article 47 permit guidance. Family or group family day care is another category. Give the agent your exact license or permit type, address and capacity before accepting a proposal; a generic “New York daycare” description leaves important details unresolved.

Start with liability that describes your actual childcare activities. Ask how the policy handles an injury during supervision, a visitor’s fall and an allegation involving an employee. General liability, professional liability and abuse or molestation coverage can have different exclusions and limits; a single large number on a quote does not answer all three questions.

For a leased center, send the lease’s insurance paragraph to the agent. Check the legal operator’s name, premises address and any required additional-insured endorsement. The landlord’s building policy and your furniture, supplies and tenant improvements are separate purchasing questions. Ask what business-income coverage requires before it pays; do not assume every licensing closure or interruption qualifies.

How much does New York daycare insurance cost?

There is no single premium for every daycare. As a broad reference, Insureon’s national human-and-social-services customer medians are $91/month for general liability, $135 for a business owner’s policy and $99 for professional liability, checked September 13, 2026. That sample is broader than daycare; these are not state daycare averages or Simply Business prices.

Use those figures only to understand separate budget categories. A business owner’s policy can bundle liability and property, so do not add every figure as though it were a required package. Request a childcare-specific proposal using your program type, child count and ages, payroll, transportation, claims history and required limits.

Compare the total annual premium, deductible, included activities and any separate abuse-coverage limit. Ask about installment charges, endorsements and the cost of changes during the year. Two prices are comparable only after the provider explains the differences in protection.

To compare a home program with a center proposal, give both providers the same enrollment and services. A quote for a home with no employees or transport cannot establish a fair budget for a staffed center that picks children up from school. Ask the agent to separate the price of optional additions from coverage required by your permit, employer obligations or lease.

Workers’ compensation, disability benefits and Paid Family Leave

New York employers should check Workers’ Compensation Board coverage requirements before hiring. Do not assume a part-time assistant is outside the rules, or that a contractor label settles the question. Tell the provider about the entity, owners, employee duties and payroll so it can identify the appropriate policy and any applicable exemption.

Disability benefits and Paid Family Leave have separate coverage rules. Generally, employing at least one person in New York on 30 days in a calendar year makes an employer subject to the Disability Benefits Law four weeks after the 30th day, subject to applicable exceptions. Ask when your obligation begins and which evidence is needed. Buying general liability or workers’ compensation does not, by itself, answer this separate benefits question.

Home care, school pickup and trips: resolve the gaps before binding

For care in your residence, disclose the business to your home insurer and ask for a written explanation of how childcare liability and business property are treated. Compare any proposed endorsement with a separate childcare policy using the same capacity and activities. Do not assume a residential policy covers the program simply because the work happens at home.

If you or staff transport children, describe who owns the vehicle, who drives, seating capacity and the trips offered. Ask about commercial auto and hired/non-owned exposures as applicable. A liability certificate for the premises does not establish vehicle coverage. For walking trips, playground visits or water activities, have the provider confirm whether the proposed childcare coverage includes those activities.

  • Legal operator name, address, permit or certificate type and requested coverage date.
  • Licensed capacity, actual enrollment, ages served, hours and all locations.
  • Staff, volunteers, payroll and screening/supervision procedures.
  • Transportation, field trips, water activities and other services offered.
  • Existing policy, claim history and insurance requirements from leases or contracts.

Ask each provider to identify the named insured, covered activities, limits, deductibles, exclusions and endorsements. Confirm whether defense costs reduce any relevant limit and how claims must be reported. If a quote cannot cover an activity, resolve that gap rather than assuming a certificate will make the proposal acceptable.
