Oklahoma daycare liability insurance: $200,000 with specified exceptions
Section 404.3 of Title 10 requires at least $200,000 in general liability coverage for each occurrence of negligence, covering injury to a child while in the facility’s care. The Oklahoma Human Services licensing requirements, effective November 1, 2025, include the statutory text and program insurance rules.
The law specifies an exception process when coverage cannot be obtained for financial reasons or because no underwriter will issue it, when policy limits are exhausted, or when the facility reports lawful self-insurance. The facility must notify the Department, post the required notice and retain signed parent acknowledgments. This is a defined exception process, not simply a choice to ignore the minimum.
Ask your licensing specialist which requirements apply to your program category and circumstances. If you are obtaining coverage, have the agent confirm that the policy covers childcare operations and provides the annual insurance verification required by the statute. If relying on an exception, confirm the required documents and notices before proceeding. A parent acknowledgment does not provide insurance or remove responsibility for negligence.
Oklahoma insurance notices and renewal records
The program rules call for an insurance-exception notice when liability coverage is not maintained or the program reports being self-insured. The statutory notice belongs at the main entrance in a conspicuous location, and a copy goes to each child’s parent or guardian. Keep the Department informed of the insurance status rather than treating a sign alone as the complete process.
Insurance and compliance-file parent notifications recur every 12 months under the program rules. Keep those records alongside current insurance evidence, and arrange the next policy before the present one expires. Ask the insurer how it will notify you of cancellation, nonrenewal or exhausted limits so that your licensing records and parent communications stay accurate.

The $200,000 figure is a statutory minimum, not a recommendation that this amount will cover every loss. Give the agent any higher limit required by a lease or another agreement. Compare higher-limit options using the same childcare activities and deductible, and ask how any aggregate limit or defense-cost provision affects the protection available.
Review general liability, professional liability and abuse or molestation coverage separately. Ask how the proposal handles a premises injury, an allegation about supervision and an allegation involving an employee. Check insured persons, exclusions and any separate abuse-related limit. A certificate showing general liability does not explain every one of those exposures.
How much does Oklahoma daycare insurance cost?
There is no single premium for every daycare. Use those figures only to understand separate budget categories. A business owner’s policy can bundle liability and property, so do not add every figure as though it were a required package. Request a childcare-specific proposal using your program type, child count and ages, payroll, transportation, claims history and required limits.
Compare the total annual premium, deductible, included activities and any separate abuse-coverage limit. Ask about installment charges, endorsements and the cost of changes during the year. Two prices are comparable only after the provider explains the differences in protection.
For a useful comparison, request the same enrollment, age groups, staffing and operating hours on every proposal. Tell providers about school-break programs and off-site activities if offered. If one insurer cannot cover your activities, ask what is excluded and what alternative coverage would be needed before comparing its premium with a more complete proposal.
Workers’ compensation: review the first hire and owner status
Oklahoma’s Administrative Workers’ Compensation Act distinguishes covered employees from specific statutory exclusions. Review the obligation before hiring an assistant rather than assuming a small daycare is automatically exempt. Ask the provider to examine the entity, payroll, worker duties and any claimed exemption.
The law treats sole proprietors and partners differently from employees, and includes an ownership-based exclusion for qualifying LLC members and stockholder-employees with at least 10% ownership unless they elect coverage. Family-employment and other exclusions have their own conditions. An owner’s exclusion does not establish that every worker at the daycare is excluded; have the provider confirm the current treatment of each role.
Give the agent a roster that includes assistants and substitutes, with estimated annual payroll. Workers’ compensation for an employee’s work injury is separate from liability coverage for a child’s injury. Calling a worker an independent contractor does not by itself determine which coverage obligations apply.
Home property and transportation: describe the actual operation
For care in a residence, disclose the daycare business to the home insurer. Ask how the residential policy treats childcare liability and business equipment, and compare any offered endorsement with a separate childcare policy. Confirm covered capacity and activities before relying on the proposal.
If you transport children, provide vehicle ownership, driver, seating and trip details. The program rules separately address vehicle insurance. Ask the provider about commercial auto and hired/non-owned exposures as applicable, and have the licensor confirm required evidence. A policy covering the daycare premises does not establish coverage for a school pickup vehicle.
