California is the state where the license may simply not be for sale. General licenses — the ones covering spirits — are rationed by county population, so where the quota is full, ABC has none to issue at any price and your only route is buying one from an existing licensee. New ones are handed out by annual priority drawing, and the 2026 application window is September 14–25, 2026. RBS Certification: Required for Every Server and Manager

Assembly Bills 1221 and 82 made Responsible Beverage Service training mandatory for on-premises alcohol servers and their managers, effective July 1, 2022. ABC defines a server broadly — anyone who checks customer identification, takes alcoholic beverage orders, pours drinks, or delivers them to customers. A manager is anyone who trains, directly hires, or oversees servers.

The Business License: What ABC Actually Issues

California licenses are numbered types, and the split that matters is general (includes distilled spirits, quota-limited) versus non-general (beer and wine, not rationed the same way):

  • Type 47 — On-Sale General, Eating Place: beer, wine, and spirits, and it also authorizes off-sale beer and wine. Quota-limited — and the “eating place” part is a live obligation, not a label: ABC requires a bona fide eating place with suitable kitchen facilities and actual and substantial sales of meals. Restaurants that drift into being bars lose Type 47s over exactly this test. Minors are permitted.
  • Type 48 — On-Sale General, Public Premises: the bar/tavern license (no food requirement, no minors). Also quota-limited.
  • Type 21 — Off-Sale General: the liquor store license — beer, wine, and spirits for consumption off the premises. Quota-limited.
  • Type 41 — On-Sale Beer and Wine, Eating Place: a non-general license. No spirits, dramatically cheaper, not subject to a population cap, and available year-round rather than through the drawing. This is the genuinely open door in California licensing.
  • Type 20 — Off-Sale Beer and Wine: also non-general and also outside the priority drawing — but do not assume one is available. Type 20 carries its own population limit of one per 2,500 inhabitants of the city or county, and in a city and county, Type 20 and Type 21 together are capped at one per 1,250. Where that is full, a store buys an existing Type 20 rather than applying for a new one.
  • Every on-premises location also needs its people certified — RBS is a staffing requirement, not a one-time filing.

The License Is Rationed, and the Window Is in September

Here is what makes California different from almost every state on this site: you cannot simply pay the fee and get a full-liquor license. The number of general licenses that may exist in each county is fixed by a population ratio. Where a county is at its cap — which is most of the desirable ones — ABC has nothing to sell you.

Two doors, then. The annual priority drawing: ABC announces how many (if any) new general licenses each county gets, accepts applications during a short window — September 14–25, 2026 this year — and holds drawings the week of October 26, 2026 in counties with more applicants than licenses. It is a lottery, and in many counties the answer is zero licenses available.

Or buy one. Existing licenses change hands privately, and ABC charges $1,565 to process a person-to-person transfer of a general license. The transfer fee is the small part: the license itself sells at whatever the local market will bear, which in supply-starved counties is the largest single line item in opening a bar. How to Get Licensed, In Order

  1. Decide general or beer-and-wine — Type 47/48/21 (spirits, quota, drawing) versus Type 41/20 (no spirits, no queue). This decision drives everything after it.
  2. Check your county’s availability in ABC’s priority drawing announcements before you sign a lease.
  3. Register the entity with the Secretary of State, and budget the $800 annual franchise tax from year one.
  4. Apply — during the September 14–25, 2026 window for a priority general license, or any time for a non-general license or a person-to-person transfer.
